Terms of Service

These Terms of Service (“Terms”) govern your use of hustleshipja.com and the services provided by HustleShipja (“HustleShipja”, “we”, “us”, or “our”). By creating an account, requesting a quotation, submitting a package, asking us to source or purchase an item, using our delivery services, or otherwise using our website or services, you agree to these Terms.
1. Our Services
HustleShipja may provide freight forwarding, shipping coordination, package handling, delivery, item sourcing, online-purchase assistance, and related logistics services. Service availability, rates, delivery areas, carrier schedules, and transit times may change without notice.
We may use airlines, sea-freight carriers, couriers, merchants, payment providers, warehouses, and other third parties to perform services. Where a third party is involved, its applicable terms, carrier rules, and legal requirements may also apply.
2. Customer Responsibilities
You agree to provide complete, accurate, and current information for yourself, the sender, recipient, shipment, and requested service. You are responsible for:
- ensuring that you have the right to ship, purchase, receive, or authorise us to handle each item;
- accurately describing items and providing invoices, proof of value, and other documentation requested by HustleShipja, a carrier, or customs authorities;
- providing a safe, accurate, and accessible delivery address and recipient contact information;
- reviewing quotations, charges, and order details before authorising service; and
- complying with all applicable laws, customs requirements, export/import rules, and carrier restrictions.
You must promptly notify us if your contact, delivery, shipment, or purchase information changes.
3. Prohibited and Restricted Items
You must not submit, ask us to purchase, or ask us to transport any item that is unlawful, unsafe, prohibited by law, restricted by a carrier, or prohibited by HustleShipja.
Examples include weapons, ammunition, explosives, firecrackers, flammable or hazardous materials, pepper spray, toy guns, unprocessed meat, live animals, cash, camouflage items, radar detectors, lighters and matches, and any other restricted item. This list is not exhaustive.
We may refuse, hold, return, dispose of, report, or otherwise handle an item as required by law or safety rules. You remain responsible for all charges, losses, penalties, and costs arising from prohibited, restricted, or incorrectly declared items.
4. Quotes, Charges, Taxes, and Customs
Quotes and rate information are estimates unless we expressly state otherwise. Final charges may change based on actual weight, dimensions, item value, shipping method, special handling, carrier charges, delivery location, exchange-rate effects, customs assessment, taxes, duties, storage, or other applicable fees.
You are responsible for all applicable service charges, taxes, duties, customs fees, penalties, storage charges, and other amounts associated with your shipment or purchase. Customs fees may apply to packages valued at USD $100 or higher, subject to the applicable laws and authorities’ assessment.
We may require payment before releasing, delivering, or continuing to process a shipment or order. If an amount remains unpaid, we may place the shipment or order on hold and pursue lawful collection of the outstanding amount and reasonable collection costs.
5. Purchase and Item-Sourcing Assistance
When you ask us to source or purchase an item, you authorise us to use the information and budget you provide to assist with the transaction. Product availability, price, vendor reliability, fitment, compatibility, authenticity, warranty coverage, and delivery timing are not guaranteed unless we expressly confirm them in writing.
For auto-parts requests, you should provide the VIN or chassis number, vehicle model information, part description, quantity, and any relevant side, trim, or specification. You are responsible for confirming that a proposed item is suitable for your intended use before purchase or installation, unless HustleShipja expressly provides a written fitment confirmation.
Merchant returns, exchanges, cancellations, warranties, and refunds are governed by the merchant’s own policies. Any assistance from HustleShipja with a merchant claim does not guarantee the merchant’s decision.
6. Delivery, Transit, and Delays
Delivery and transit dates are estimates, not guarantees. We are not responsible for delays caused by weather, carrier schedules, customs inspections, government action, security procedures, labour disruptions, incorrect or incomplete information, unavailable recipients, acts of God, or other events outside our reasonable control.
You or your authorised recipient must inspect delivered items promptly and report visible loss, damage, or delivery issues to us as soon as reasonably possible, with supporting photographs and documentation where available. Late reporting may limit our ability to investigate a carrier or merchant claim.
7. Loss, Damage, and Limitation of Liability
To the maximum extent permitted by applicable law, HustleShipja is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profit, income, use, business opportunity, data, or goodwill; or losses caused by a third-party carrier, merchant, customs authority, or other provider.
Where HustleShipja is legally liable for a direct loss arising from its services, our liability will not exceed the amount you paid to HustleShipja for the specific service giving rise to the claim, except where applicable law requires otherwise. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
You may be offered optional insurance, declared-value coverage, or other protection where available. Such coverage is subject to its separate terms and is not in effect unless expressly confirmed in writing.
8. Account Security and Website Use
You are responsible for safeguarding your account credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorised access.
You may use our website only for lawful purposes. You must not interfere with the website, attempt unauthorised access, introduce malicious code, scrape or copy content in a way that breaches these Terms or applicable law, or use the website in a manner that harms HustleShipja, our customers, or third parties.
9. Intellectual Property
The HustleShipja name, logo, website content, branding, and other materials are owned by or licensed to HustleShipja and are protected by applicable intellectual-property laws. You may not use them without our prior written permission, except as permitted by law.
10. Suspension or Termination
We may refuse, suspend, or terminate access to the website or services, or cancel or hold a shipment or order, where we reasonably believe there is fraud, non-payment, unsafe conduct, inaccurate information, a breach of these Terms, or a legal, customs, or carrier requirement.
11. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using our services, you acknowledge that we may process personal information as described in that Policy.
12. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on our website and update the effective date. Continued use of the website or services after the revised Terms take effect constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of Jamaica, without regard to conflict-of-law principles. Before starting formal proceedings, you agree to contact us and give us a reasonable opportunity to resolve the concern. Nothing in this section limits either party’s right to seek urgent relief where appropriate.
